By using the Services, you understand and agree to all contents of this Terms
of Service. When member uses the Services, it means that member also accept the
Regulations of Membership( including Rules of Games, Contents of Support and
Specifications for services of the Announcement) provided by joycrit.com, and
comply with relevant laws and regulations except the Terms of Service.
If you are under the age of twenty(20), you may use the Services only with the
involvement of your parent or guardian. Make sure you review these Terms with
your parent or guardian so that you both understand all of your rights and
responsibilities.
2. Additions & Amendments of Members Terms of Service
JOYCRIT.COM will retain the rights to add and revise the Terms of Services. The Terms may be updated from time to time
without notice to you and announced at website homepage. Please do not continue
to use this Terms if the amended contents is not accepted. You agree to the
amended clauses if you are continue to use the services after the amendments announced.
3. Introduction of the Services
You have the rights to enjoy all services of the website including games,
leisure and community. Joycrit will continue to provide more network services.
Members who accept the Terms must be equipped with the necessary computer
equipment, as well as afford related telecommunication expenses including GPRS, VPN or telephone charges.
4.Responsibilities
and Obligations
a. You agree to provide correct and real profile when you register as member.
You shall update your personal information online at any time if changed.
JOYCRIT.COM will hold the rights to terminate your membership at any time if
your registered profiles is not real or not updated after being warned.
b.1.Members shall not conduct commercial use of the Services.
b.2.You shall comply with related regulations on the Use and Etiquette of
International Internet in addition to abide to the Terms.
b.3.Any articles or images that contain abuse, slander, inelegance, obscenity
or aggressiveness are forbidden to delivery or publish.
b.4.Members shall agree to protect Intellectual Property Rights, and no one
shall post text, images or files in other forms that violate other' s property rights.
c.1. The Terms will come into force when you register as a member of the
website, and all rights are reserved to the JOYCRIT.COM. Members shall use
rights in accordance with the Terms and any renting, selling or transferring
actions are prohibited.
c.2. Members are obliged to keep your account, password and other information
related to membership confidential. You are responsible for the activity and
behavior that happens on or through your Account.
c.3.If you find that your account or password is disclosed or used illegally by
other people, please contact JOYCRIT.COM in time. JOYCRIT.COM will not take any
responsibility for the illegal use of your account by others that is caused by
negligent password keeping.
5.Responsibilities and Obligations of Payments
When members make a purchase on this website, you shall know that funding can
not be canceled, changed, refunded or transferred into other services of the
website. If you make purchases in an illegal way, the Company may terminate
your access to all or any part of the Services at any time. Whoever violates
the provisions of the preceding paragraph shall be investigated for legal
liability.
JOYCRIT.COM have the rights to suspend your account if you refund on purpose or
without reasons after funding.
6.Termination & Amendments of the Services
JOYCRIT.COM holds the rights to terminate or change member's account without
prior notice if member have any of the following situations. Troubles,
inconvenience and damage caused by termination or changes of the use of
members, the Services will not be responsible for any member or the third
party.
1.You register as member with false information.
2.You use as a username a name of JOYCRIT.COM or one similar to it.
3.Use, as a username, a name that is otherwise offensive, vulgar or obscene or
contains characters except Chinese, English, Number.
4.Use as a username a name subject to any rights of a person other than you
without appropriate authorization.
5.Make purchases in an illegal way.
6.Violate the Terms of Service.
7.Violate public security, public order and the good and honest custom.
8.Violate the regulations of existing law.
7.Suspension or Interruption of Services
JOYCRIT.COM retain the rights to suspend or interrupt all or one of the
Services with the following situations. The Services is not responsible for any
member or the third party if there causes any trouble, inconvenience or damage.
1.Related hardware and software equipment and telecommunication equipment
carries out maintenance or operation.
2.Telecommunication equipment breaks down abruptly, unable to transmit data.
3.Due to natural disasters and other force majeure factors, the service is
unable to execute.
4.To maintain the integrity and safety of data of other members or the third
party in emergency.
Please aware that your carrier's normal rates and fees will still apply during
suspension or interruption if any or parts of the Services is suspended or
interrupted because you violate the laws or the Terms of Service.
8. Rights of Services Changing
JOYCRIT.COM will retain to add, revise or delete all or parts of the Terms
without notice to you. Members shall have no claim for any compensation as a
result of the changes.
9.Scope of Responsibilities
The Terms provided specific user with special needs, and JOYCRIT.COM do not
guarantee that any Content will be made available on the Site or through the
Services.
The services may not function well due to the following problems: break down or
malfunction of the third party or related software and hardware equipments of
telecoms network system; interrupted or delayed of data transmission or storage
by unreasonable operations; fabricated information by hacker attack of the
third party. Regarding the above circumstances, JOYCRIT.COM do not guarantee
the stability, safety, inerrancy and continuity of all services. Members shall
understand the risks and damage that may occur of the Services, and release us
from any claims and compensations.
10.Members data processing and Privacy Policy
By registering as member, you are
authorizing JOYCRIT.COM to reserve, search, use, share and protect your
personal information within reason, and collect your information for the
purpose of providing you with other services, or as member data statistics and
survey or any legal use.
JOYCRIT.COM is obliged to keep your personal information confidential and will
not disclose any of your personal information such as user-name, address,e-mail
to any third party without your permission. But we may share your personal information with the third party under
any of the following circumstances:
1.As required by laws and regulations of judicial organ, police or other administrative
authority.
2.In order to safeguard the public interest or protect rights and interest of
JOYCRIT.COM or other people.
3.Members violate the laws and regulations of China or the Terms of Service.
4. The company safeguard the integrity and safety of data including transaction
contents, game process and personal information of other members or the third
party in emergency.
11.Management of the Games
1.Data or Information Transfer: In the case of the merger of game server, the
Company hold the rights to transfer user's profile to other game server.
2. In order to regulate game playing, JOYCRIT.COM shall set up reasonable and
fair Rules of Game Management. Members shall comply with the Rules of Game
Management.
3.The Rules of Game Management may be unavailable with one of the following
circumstances:
(1)Conflict with the regulation of the online game stereotypes that should be
documented or shall not be recorded. .
(2)Deny or abridge the obligations of member. But when JOYCRIT.COM dispose
violators, the provision 4 section 7 will still apply.
4.Game server shut down: the Company shall notify members via notice on website
30 days in advance.
5.Members shall comply with User Code of the Service
(1)You shall not modify, decompile or take any other action that may effect the
game program and network data transmission;
(2)You shall not use any methods to maliciously in-break, attack or destroy the
normal operation of network server;
(3)No game bugs or incorporate third-party plug-ins are allowed to be used for
earning money, reproducing equipment or accumulating experience that destroy
the game fairness and the server;
(4)It is forbidden to publicly or privately distribute any game bugs that are
available. Please respond to JOYCRIT.COM as soon as you find such questions;
(5)Username that contains personal attack, obscenity, abuse, counteraction or
other hazards of the game image, with the GM role name deliberately similar to
disrupt the normal service order and violation of social goodness are
prohibited to be used;
(6)Refuse to brush the screen or disturb the social order and destroy the
social stability;
(7)GM have the rights to warn,enforce log out, confinement, rename, delete
characters or block account of member in violation of the above provisions . If
any serious consequence shall be pursued by laws, members shall bear any damage
or circumstances caused thereby;
(8)Except as the Terms provided, JOYCRIT.COM shall announce members who turn out to be violating the
Rules of Game Management on the game website or during game processing and
notify members through online Real-time communication or E-mail. Members shall
improve behaviors once JOYCRIT.COM notified, otherwise may be limited to use
the rights of game according to the circumstance under the Rules of Game
Management;
(9)JOYCRIT.COM shall terminate the rights of member to play game in accordance
with the Rules of Game Management, which may not exceed 7 days;
(10)JOYCRIT.COM shall punish member improper action under the Rules of Game
Management and shall not affect the entitlements of the Terms except as
provision 12 provided.
12.The
Company Has the Right of Termination
JOYCRIT.COM shall refund unused funding or fee on the game, after the deduction
of costs, through cash, credit card, draft or register to send a cheque to
members within thirty days after the termination of the Terms. .
Members shall comply with related laws and regulations of China and the Terms.
JOYCRIT.COM shall terminate the Terms or suspend, or delete member's account
including related information, profiles and any records after notifying in
written form or E-mail, as well as cancel, terminate and limit the membership.
1.Use any systems or methods to maliciously in-break, attack or destroy the
normal operation of network server. .
2.Use plug-ins, virus program, game bugs or other methods that violate the
rules to play the game. .
3.Any illegal acts seized by judicial authorities.
4.Other actions jeopardize JOYCRIT.COM or other user's rights and benefits.
JOYCRIT.COM shall be liable for any compensation due to the facts that are
found to be wrong or unable to be proved.
In order to provide member with the Services, JOYCRIT.COM shall take
maintenance on official website or game server, which may interrupt the
services without any prior notice.
Except the failure to take reasonable measures, JOYCRIT.COM shall not be
responsible for the suspension or interruption of the services caused by hacker
attack, fabricating, deleting, decompiling system or data.
13.Intellectual Property Rights
The website may contain Content specifically provided by JOYCRIT.COM or our
users and Content contains copyrights,
patent right, Trademarks, Trade secret, other Intellectual property rights.
Unless agreed by the Company or the its users therefore, no one shall
distribute, publish, compile, edit or use it in other forms or with any purpose
without authorization. Otherwise violators are responsible for related laws.
14.Validity of Some Terms
If it turns out that a particular term is not enforceable, this will not affect
any other terms.
15.Applicable Law
The interpretation, performance of this Terms and the relationship of rights
and obligations between members and JOYCRIT.COM shall be governed by laws and
regulations of the People’s Republic of China.
16.Competent Court
You agree that any dispute arising from the Terms of Service shall be governed
by the Court of Tianhe District, Guangzhou.
Important Statement:
If there is any conflict between Chinese and English version of this Terms and Service, the Chinese version will control for the conflict.
